Notices, Policies, and Disclosures

Disclosure Under the California Transparency in Supply Chains Act of 2010

Our goal at Fertizona and Compton Ag Services, through the manufacture and sale of premium crop protection, crop nutrition and seed products, is to facilitate the growth and betterment of the communities that we serve, helping our customers to achieve the maximum potential from their operations. Fertilizer Company of Arizona, Inc., an Arizona corporation and Compton Ag Services, L.L.C., a California limited liability company, (collectively “Fertizona”) are dedicated in providing you with essential services and products ensuring that the crop nutrients and crop protection products that we sell are supplied in an ethical and responsible manner. With regard to specific requirements of the California Transparency in Supply Chain Act of 2010, our practices include:

VERIFICATION

We routinely assesses risk related to our supply chain based primarily upon supplier quality performance, type of transaction, the specific commodity purchased, security standards, the geographic location of the source and other relevant business and legal criteria. We follow the trade laws of the United States and applicable laws of countries in which we operate, including the restrictions on export or doing business with certain people, companies or countries. Other than routine evaluation of our suppliers, Fertizona has no formal process for verification of product supply chains to evaluate and address risks of human trafficking and slavery.

AUDITING

We do not engage in verification of product supply chains to evaluate and address risks of human trafficking and slavery. Fertizona does not independently audit any of its suppliers to evaluate supplier compliance with company standards against trafficking and slavery in supply chains. Nonetheless, suppliers of crop nutrients and crop protection products are subject to inspections, announced and unannounced, by government agencies and third parties to ensure compliance with applicable laws including standards governing the manufacture, sale, labeling, branding, packaging, shipment, importation and distribution of agrichemicals.

CERTIFICATION

All of Fertizona’s crop nutrient or crop protection suppliers who sell products in California must certify their compliance with the terms of the California Transparency in Supply Chain Act of 2010.

INTERNAL ACCOUNTABILITY

In all business dealings, Fertizona’s employees are required to operate within the law and to obey all applicable federal, state, local, and international laws and regulations. As part of company philosophy, Fertizona prohibits contracting with suppliers who use forced labor, child labor, whose practices violate applicable standards for working hours and conditions, and other subjects related to human trafficking and slavery.

TRAINING AND AWARENESS

Fertizona regularly trains its employees in work standards which includes ethical behavior, company policies and procedures and legal requirements that establish the manner in which we conduct business. In 2015 we commenced training of employees who source product or contract with our suppliers on human trafficking and slavery.

Privacy Statement Business to Business Credit Data

At Fertizona and Compton Ag Services we are committed to protecting your privacy. Federal and state law require us to tell you how we collect, use, share, and protect your personal information. The laws apply mostly to your personal credit (personal, family or household purposes) and limit how we can use that personal information. Generally, Fertilizer Company of Arizona, Inc., an Arizona corporation and Compton Ag Services, L.L.C. (collectively “Fertizona”) does not collect any information from individuals; the scope of our relationship is with your business which is not subject to most of the privacy laws.

This Privacy Statement does not apply to business credit transactions. This Privacy Statement does not change the terms or any existing credit application or contract, nor change the way that Fertizona handles or reports credit data as a business credit provider.

This Privacy Statement describes the information that may be collected and how we protect your information.

INFORMATION WE COLLECT

We gather nonpublic information about our agribusiness customers as may be necessary to conduct business. We collect information about your business from the following sources:

  • • From sales of agrichemicals, equipment, supplies or services we may collect information such as your business or company name, address, employer identification number, e-mail address, or other financial information.
  • • From transactions with Fertizona, we may collect information on your purchasing history, product volumes, crops, acreage, fields, pests, harvest, agrichemical applications, service area, sales force and other information about your business.
  • • We may collect business account information, credit history, tax return information from third parties such as credit bureaus or electronic tax return originators, and other information relating to the creditworthiness of your business.

 

INFORMATION WE DISCLOSE

We do not disclose any nonpublic personal information about individuals, except as permitted by law. We may continue to transmit business credit information which is not subject to notice and opt-out provisions that may be available to individual consumers. We may disclose the business information we collect including:

  • • To provide crop and research data. Fertizona may collect, retain and use aggregate, non-user specific information on agricultural crops, crop protection chemicals, regional use, and other agricultural data in blind, collated, assembled or bundled reports.
  • • To comply with legal requirements. Fertizona may be required to disclose your personal or business information in order to comply with legally mandated reporting or disclosure requirements (such as responding to a valid subpoena, warrant, audit, or agency action, or to prevent fraud) or to credit reporting agencies and companies which provide services related to your business account. This information sharing is permitted by law. Fertizona will use reasonable efforts to limit the personal information it provides for this purpose. We may also disclose information if appropriate to protect our intellectual property or our legal rights.
  • • To third-party crop protection product suppliers. Suppliers who do business with Fertizona may request grower sales data which may include grower name, address, invoice number and date, product name and quantity purchased. These companies agree to safeguard our confidential business customer information and they must abide by applicable law. We will not disclose this specific information without your authorization.

 

INFORMATION SECURITY

Fertizona is committed to keeping confidential information secure. We have appropriate technical, administrative and physical procedures in place to protect information from loss, misuse or alteration. We educate our employees about the importance of confidentiality and customer privacy. We restrict access to nonpublic business credit information to those employees who need to know that information.

YOUR BUSINESS PRIVACY CHOICES

PLEASE NOTE THAT THE OPT-OUT PROVISIONS AVAILABLE TO BUSINESSES DIFFER SIGNIFICANTLY FROM YOUR PERSONAL CHOICES. THE FOLLOWING OPT-OUT SELECTION DOES NOT IMPACT, CHANGE OR AFFECT, IN ANY WAY, THE MANNER THAT FERTIZONA SHARES BUSINESS CREDIT DATA IN ACCORDANCE WITH THE LAW.

Unless you notify us of your desire to withhold grower sales data, we may share information about your business as noted above with crop protection product suppliers for their marketing use. Once you notify us of your desire to restrict the transmission of grower sales data, they remain in effect until you request a change. Please allow approximately 30 days from our receipt of your privacy choices for them to become effective.
